The supply of the Services shall be subject to these Terms and Conditions:
Transcriptions shall be carried out in accordance with our standard Transcription Policy.
McGowan Transcription Ltd retain the right to accept or decline any orders for transcription services.
Except where otherwise agreed, our price structure is based on a per audio minute basis, with costs for each audio file being calculated to the next whole minute.
Rates will be reviewed annually and any increases will be notified within one month of implementation.
All prices are quoted exclusive of VAT which shall be applied at the prevailing rate.
An invoice will be issued on completion of each transcription project. Payment shall be made on completion of the transcription project, unless a monthly account has been agreed, whereupon the invoice will be issued on the last working day of the month in which the transcription project was undertaken.
High volume projects will be invoiced weekly.
Payment is due strictly 14 days from the date of the invoice unless otherwise stated.
If the project is on-going and rolls over several months, an invoice will be created the last Friday of each month.
For private individuals and overseas clients, a 25% deposit will be payable at the outset, and the remainder of the fee charged on completion of the transcription project will become due immediately.
Please note that payments made via PayPal are subject to a 3.5% surcharge applied to the invoice total.
Payment can be made by: Cheque payable to McGowan Transcriptions Ltd, Bank transfer and PayPal.
We reserve the right to charge interest on overdue amounts at a rate of 8% above the Bank of England base rate on the outstanding balance from the date of the invoice until the date of payment.
In the event of any cheque from a client being refused by the bank, the client will be responsible for all bank charges resulting from the returned cheque.
McGowan Transcriptions Ltd will endeavour to complete the transcription project by the dates agreed with you but time shall not be of the essence in this regard. If there is any reason why completion of the transcription project is going to be unduly delayed, McGowan Transcriptions Ltd shall inform you as soon as possible.
We reserve the right to change turnaround times and prices quoted due to changes in the specifications, quantities, legibility and / or quality of origin or source material or delivery.
McGowan Transcriptions Ltd cannot be held liable for damage to any media supplied by the customer either in our possession or in transit.
All transcripts returned to clients remain the property of McGowan Transcriptions Ltd until full payment is received.
All minutes transcribed until written notification of cancellation of project is received will be paid for by the client.
McGowan Transcriptions Ltd will undertake to keep all information supplied by you strictly confidential.
All transcribers have signed full and comprehensive confidentiality agreements.
All transcribers are required to comply with our strict security compliance measures. A copy of our Compliance Manual can be provided upon request.
Clients will be deemed to be responsible for proofreading all completed transcripts and no responsibility will be accepted by McGowan Transcriptions Ltd for any errors arising in final copies of a completed transcript or any loss, damages, costs, expenses or liability suffered by you and arising from your subsequent use of any documentation produced. In the very unlikely event there are any errors in transcripts identified within 48 hours of completion, we will amend the transcript free of charge.
File shredding policy
We will not hold files on our systems past 1 calendar month after sending the completed transcripts to our clients, due to our security protocols. This means that within 30 days after completing the project, our copies of the files that we have created for you will be shredded. We use Fileshredder software for this, so when it’s gone, it’s gone. We have this file shredding policy for client privacy and security reasons. As with all we do, our aim is to provide top quality products and services. Safeguarding your data security is crucial to us, but we strive to keep its impact on convenience to a minimum. Please always let us know if there is an unavoidable delay or any problem with downloading files from us.
You agree to keep a copy of all Client Material you send to McGowan Transcriptions Ltd. McGowan Transcriptions Ltd shall not be liable for any loss, damage, costs, expenses or other claims arising from any Client Material which is lost or damaged of which you have not retained a copy or for damage to any tapes or mechanical failure of a cassette/disk/video/DVD. We do not insure or guarantee any cassettes, CDs or DVDs and they remain the customers’ responsibility.
Recordings will be kept on our ScribeManager system for 48 hours before deletion.
McGowan Transcriptions Ltd reserves the right to defer or to cancel the Contract without liability to you if it is prevented from or delayed in the carrying on of its business due to external circumstances outside its reasonable control, including but not limited to, acts of God, fire, acts of terrorism, breaks in electricity supply or telecoms. McGowan Transcriptions Ltd does not accept liability to Customer for direct or consequential economic loss (including loss of profit or business).
